The latest European Court of Justice (ECJ) judgment on margin squeeze provides valuable clarification on one of the more controversial abuse of dominance claims ( see box "Margin squeeze") ( Konkurrensverket v TeliaSonera Sverige AB, Case C-52/09 ). The judgment is particularly significant as it confirms that margin squeeze is a separate form of abuse in its own right. Since the book went to press, the Court of Justice has given a preliminary ruling in the TeliaSonera case (Case C-52/09, Judgment of the Court (First Chamber) of 17 February 2011, Konkurrensverket v TeliaSonera Sverige AB, ECR reports 2011 Page 00000), and the European Commission has issued a prohibition decision against Telekomunikacja Polska, the Polish telecoms operator, fining it € 127 million for a margin squeeze. Konkurrensverket v TeliaSonera Sverige is the first case in which the Stockholm District Court penalized the highest fine of a total amount of SEK 144 million due to a violation of Chapter 2, Section 7 of the Swedish Competition Act and Article 102 TFEU respectively. In the year 2004, the Swedish Competition Authority (Competition Authority) brought an action against TeliaSonera, a telecom operator. 2 Case C-52/09, Konkurrensverket v. TeliaSonera Sverige tillbakavisar KKV:s påståenden om så kallad prisklämning och att TeliaSonera Sverige i övrigt skulle ha agerat i strid med konkurrensreglerna på bredbandsmarknaden. Konkurrensverket vänder sig nu till Stockholms tingsrätt med krav på att Gothnet ska betala 16 960 000 kronor, och Telia Sonera 18 800 000 kronor i böter / konkurrensskadeavgift. 1 TeliaSonera Aktiebolag (TeliaSonera) har yrkat att Marknadsdomstolen, med ändring av tingsrättens dom, lämnar Konkurrensverkets (KKV) talan om konkurrensskade-avgift utan bifall.
